1. Agreement
Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Silversea Fall Cruise Giveaway (the “Giveaway”) sponsored by Silversea Cruises Ltd. (the “Sponsor”). By participating in the Giveaway, you signify your agreement to these Official Rules and the decisions of the Sponsor and RAVEN5 Ltd. (the “Administrator”). If you do not agree to the Official Rules, you may not enter the Giveaway.
2. Eligibility
The Giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry (“participant”, “entrant”, or “you”).
Employees, officers, directors, agents, or representatives, of the Sponsor, Administrator, their respective parent companies and each of their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment, and execution of this Giveaway (collectively, the “Giveaway Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each, are not eligible to enter.
The Giveaway is subject to all applicable federal, state, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these rules has submitted an entry, that entry may be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside the fifty (50) United States of America, the District of Columbia and where prohibited by law.
3. Giveaway Period
The Giveaway begins at 12:00:01 AM Eastern Time (“ET”) on November 4, 2025, and ends at 11:59:59 PM ET on November 30, 2025 (the “Giveaway Period”). Sponsor’s database clock will be the official timekeeper for this Giveaway.
4. How to Enter
To participate, you must have a valid Instagram account or a valid Facebook account in good standing during the Giveaway Period.
To enter on Instagram, log in to your Instagram account and follow Silversea (https://www.instagram.com/silversea) on Instagram. Next, locate an official Giveaway post published by @Silversea, @theworldpursuit or @5teffy. Once you’ve located a Giveaway post, like the post and tag one (1) friend you’d love to explore Antarctica with in the comments section of the post.
To enter on Facebook, log in to your Facebook account and follow Silversea on Facebook (https://www.facebook.com/silversea). Next, locate an official Giveaway post published by @Silversea. Once you’ve located a Giveaway post, like the post and tag one (1) friend you’d love to explore Antarctica with in the comments section of the post.
Limit: One (1) entry per person during the Giveaway Period. Multiple comments or tags by the same person will not result in additional entries. Participants found to be using multiple accounts to enter, or using automated, fraudulent, or otherwise improper means of entry, may be disqualified in the Sponsor’s sole discretion.
By entering the Giveaway, you signify your agreement to these Official Rules and the Sponsor’s Privacy Policy (https://www.silversea.com/privacy-policy.html). Giveaway Parties are not responsible for lost, late, stolen, incomplete, inaccurate, invalid, un-intelligible, garbled, delayed or misdirected entries, all of which will be void. Entries which are incomplete, illegible, or fraudulent are null and void.
5. Prize/Approximate Retail Value (“ARV”)/Odds
Grand Prize: One (1) grand prize (the “Grand Prize”) is available to be won. The Grand Prize consists of:
The ARV of the Grand Prize ranges from $26,000.00 to $46,000.00 USD. ARV will vary depending on the voyage selected by the winner.
The odds of winning will depend on the total number of eligible entries received during the Giveaway Period.
Prize Conditions:
Travel for winner and his/her guest shall be booked by Sponsor following verification of the winner. Actual value may vary based on airfare fluctuations and distance between departure airport within the United States and destination. Travel arrangements are subject to availability and other restrictions. There are no deviations to travel allowed except as approved by Sponsor in its sole discretion.
As a condition of acceptance of the prize, winner will be required to sign and return: (i) an Affidavit of Eligibility, a Liability Release and a Publicity Release (except where prohibited by law), and an IRS Form W-9. Failure to comply will result in disqualification. Winner’s guest must be eighteen (18) years of age or older at the time of signing the required Liability and Publicity Releases in order to accompany the winner on the Grand Prize trip.
Winner and his/her guest must travel on the same itinerary and must each possess all required valid passports and visas (with “valid” defined in accordance with United States and applicable foreign laws) at the time of departure and continuing through return to the country of origin. If the winner does not have the required valid passport(s) and/or visa(s) at the time of departure, neither the winner nor the guest will be permitted to travel, the prize will be forfeited in its entirety, and no substitution or compensation will be provided. If the winner possesses the required valid passport(s) and/or visa(s), but the guest does not, the winner may travel unaccompanied; however, the winner will not be permitted to designate a substitute guest. In accepting a prize, winner is responsible for all federal, state, county, local and all other taxes (including income and withholding) on the prize and costs and expenses not specifically listed above as part of a prize, including, without limitation, surcharges, service charges, meals, food, beverages, insurance, valid travel documentation, passports, medical/health expenses, gratuities, excess baggage fees, communication charges, and all other personal expenses and incidentals.
Winner and his/her guest must abide by all Sponsor’s policies and terms and conditions, and comply with the Silversea Guest Terms and Conditions, available at: https://www.silversea.com/guest-terms. Sponsor reserves the right to revoke full or partial prizes from any winner or guest who it deems, in its sole discretion, may be intoxicated, be a safety risk, have violated any policy or law, or may bring the Sponsor into disrepute.
All details and other restrictions of the prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. Prize value will vary depending on the voyage selected by the winner. Actual value may be lower or higher at the time of its fulfillment, and any difference between actual value and the stated ARV (if actual value is lower than stated ARV) will not be awarded. Prize ARV represents Sponsor’s good faith determination, is final and binding and cannot be challenged or appealed. Sponsor is not responsible if any element of the prize is delayed, altered, postponed or cancelled for any reason. Prize is non-transferable, non-refundable, and no substitution or cash redemption will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right, for whatever reason, to substitute a prize (or any component thereof) for one of equal or greater value.
Sponsor, in its sole discretion, reserves the right to substitute prizes of equal or greater value if advertised prize become unavailable. Sponsor’s determinations regarding the awarding of the prize are final. No prize substitutions except as provided herein. Ships’ Registry: Bahamas. Prize is not transferable and may not be given, bartered, sold, or exchanged for cash or another prize, except at Sponsor’s sole discretion due to prize unavailability for any reason and then only for a prize of equal or greater value.
6. Winner Selection & Notification
On or about December 4, 2025, the Administrator will conduct a random drawing from among all eligible entries received to select one (1) potential winner. The Sponsor will notify the potential winner by direct message to the Instagram account used to enter the Giveaway within forty-eight (48) hours of the drawing.
The potential winner must respond to the Sponsor’s direct message within seventy-two (72) hours of notification and provide a valid email address. Once an email address is provided, a representative of the Administrator will contact the potential winner by email, and the potential winner must also respond to that email within seventy-two (72) hours of notification.
If any potential winner does not respond to both the Sponsor’s Instagram direct message and the Administrator’s email within the required time periods, fails to provide a valid email address, declines the prize, cannot be reached, or if any notification is returned as undeliverable, the potential winner may, at the Sponsor’s sole and absolute discretion, be disqualified and forfeit all rights to the prize. In such event, the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate potential winner from among the remaining eligible entries, subject to the same process.
No one is a winner unless and until the Sponsor officially confirms him/her as a winner in accordance with these Official Rules.
Before being confirmed as the winner (the “Winner”), the potential winner will be required to sign and return, within seventy-two (72) of the request, an Affidavit of Eligibility & Liability / Publicity Release form (the “Release”) which:
In addition, the potential winner will be required to sign and return, within seventy-two (72) hours of the request, an IRS Form W-9 (“W-9”) which will require the potential winner to disclose personal information including his/her Social Security Number. Sponsor will only use information from the W-9 to fulfill its tax obligations in connection with this Giveaway and for no other purpose. Failure to provide all required documentation within the specified time period will result in disqualification, and an alternate potential winner will be selected in accordance with these Official Rules
7. Publicity
Except where legally prohibited, participation in the Giveaway and acceptance of a prize constitutes entrant’s consent to the Sponsor’s use of names, likenesses, photographs, videos, voices, opinions and/or cities & states, and/or for promotional purposes in any media now known or hereafter devised, worldwide, without further payment or consideration, notice, review or approval. Sponsor reserves the right to use any and all information related to the Giveaway for promotional, marketing and any other purpose, including online announcements unless prohibited by law.
8. Limitation of Liability
By participating in the Giveaway, each entrant his/her heirs, executors, administrators and assigns releases, waives, discharges, and holds harmless the Releasees from, and against any and all loses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation any and all costs and liabilities of any kind including but not limited to lawyer’s fees), and including, without limitation, any such arising from any act of negligence of the Releasees, that the entrant now has, or may hereafter have against the Releasees directly or indirectly resulting from participation of the Giveaway or the awarding, acceptance, use, or misuse of a prize. Entrants assume all liability for any injury or damage caused or claimed to be caused by participation in this Giveaway or use/misuse or redemption of a prize.
FOR RESIDENTS OF THE STATE OF CALIFORNIA: You acknowledge and agree that your release and waiver extends to the following, the protections of which you explicitly waive:
California Civil Code Section 1542: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.
9. General
In the event of any discrepancy or inconsistency between the Giveaway materials (including, but not limited to, advertising, promotional, or marketing materials) and these Official Rules, the terms and conditions of these Official Rules shall govern and prevail. Sponsor reserves the right to interpret these Official Rules, and its decisions shall be final and binding in all matters related to the Giveaway.
Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prize. The Releasees are not responsible for: (i) lost, late, misdirected or damaged entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Giveaway.
By participating in the Giveaway, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Giveaway.
Failure to comply with these Official Rules will result in disqualification from the Giveaway. Sponsor reserves the right to permanently disqualify from any Giveaway it sponsors any person or any Eligible Company it believes has intentionally violated these Official Rules. If for any reason this Giveaway is not capable of running as planned due to any causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Giveaway termination.
10. Disputes
Except where prohibited, Participants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Florida, U.S.A. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Florida. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
11. Privacy
Personal information collected from Participants is subject to the Sponsor’s Privacy Policy, available at: https://www.silversea.com/privacy-policy.html.
In addition, any personal information that you provide may be used in connection with the Giveaway as necessary, to administer, manage and operate the Giveaway (including coordinating and fulfilling the prize and releasing a list of winners, as discussed below) and otherwise as permitted in our privacy policy referred to above.
Personal information collected will be stored on servers located in the United States and may be accessible to U.S. law enforcement, courts and other governmental institutions pursuant to the laws of the United States.
12. Winner List Requests
For a written confirmation of the winner (available after December 15, 2025), send an email to [email protected] with subject line: Silversea Fall Cruise Giveaway – Winners List Request. All requests must be received by February 15, 2026 at 2:59:59 PM ET. Requests received after this time will not be fulfilled.
