GDPR Compliance

Our cloud based email system is completely GDPR compliant in all aspects as it relates to email. Through the use of the Google Cloud Platform we can determine hosting in North America or elsewhere as required. Our process ensures that our clients are GDPR compliant. Our process for ensuring GDPR compliance:

  1. Add designated checkboxes to all email subscription proccesses
  2. Keep an electronic record (log) of all subscriptions
  3. Use simple language for EU citizens
  4. Ensure that subscribers be forgotten (if requested)
  5. Use Cybersecurity protocl (i.e. report breaches if they occur)

CAN-SPAM

Do you use email in your business? The CAN-SPAM Act, a law that sets the rules for commercial email since 2003, establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations. Despite its name, the CAN-SPAM Act doesn’t apply just to bulk email. It covers all commercial messages. Our process for ensuring CAN-SPAM compliance includes:

  1. Update email headers to ensure compliancy (i.e. From, To, Reply-To, and routing info)
  2. Review subject lines to ensure accuracy
  3. Identify messages as ads as required
  4. Provide location information
  5. Make it easy to opt out of receiving future email
  6. Review opt-out procedures
  7. Monitoring and reporting

CASL

We can review and ensure that your current databases are compliant as well as evaluate and update all current marketing communications to be compliant with Canada’s Anti-Spam Legislation, which came into effect on July 1, 2014. Going forward, all future marketing communications including forms and processes for gathering opt-ins and list building must be CASL compliant. Our process includes:

  2. Email template (customized for your brand)
